Construction Worker Accidents with Ladders

According to safety authorities such as OSHA and the Centers for Disease Control and Prevention, in the construction industry, falls from ladders remain the leading cause of unintentional fatalities across the country. In the last decade, 43% of fatal falls involved a ladder, and the unsafe use of ladders are often cited as the cause. OSHA (Occupational Safety and Health Administration) reports that almost one-third of the annual fall-related deaths in construction involves a ladder.

With the amount of construction work happening around New York and areas like the Bronx, many workers are at risk of a workplace injury. Ladders are inexpensive and easy to use, however, safety is paramount and caution needs to be followed whenever they’re being used.

The height from which you fall does not always determine the severity of an injury. Even falling from the first few rungs of a ladder can be fatal under the right circumstances – what is hit and how you land. Safety authorities like OSHA suggest that alternatives to ladders should be considered where possible because of the risk of an accident.

The length of the ladder must always fit the height of the elevated area. Ladders that are too long can be unstable, even when securely placed.

OSHA’s regulations for ladders can be found here.

Some precautions you can take:

  • Rather than working on a ladder while standing sideways, consider a platform step ladder as a safer option, especially if working at an elevated level for a long time.
  • Check for oil, grease or other slipping hazards on the steps or rungs.
  • Use only on stable and level surfaces.
  • Do not use on a slippery surface.
  • Avoid placing the ladder where it can be hit by other workers or traffic.
  • Do not move a ladder when someone is on it.
  • Do not stand on the top step of a stepladder.
  • Avoid ladders with missing or corroded rungs.
  • Climb up and down facing the ladder.
  • Avoid carrying heavy or bulky loads.

Despite the best precautions, construction accidents still occur. The state of New York workers’ compensation system is a no-fault program that pays benefits to workers regardless of who was to blame.

Construction-related businesses in New York and surrounding areas like The Bronx must offer workers’ compensation coverage for all employees. Employees have a right to receive workers’ compensation benefits. You may also have a right to pursue a personal injury claim against other parties and contractors that are not your employer. An experienced attorney can show that the building owner, or general contractor or other contractors were liable in your accident happening and you suffering injuries. This may become a Labor Law cause of action. You will want to have an experienced Labor Law attorney like the Law Offices of Stuart M. Kerner working for you. Our office deals with labor and construction accident cases and will be able to assist you in obtaining both Workers’ Compensation benefits and a recovery for your personal injuries.
